On Monday, the Apex Court cancelled bail granted to Ashish Mishra in the Lakhimpur Kheri violence case & directed him to surrender within a week

The bench of Chief Justice of India N V Ramana & Justice Surya Kant & Justice Hima Kohli said the High Court erred by taking into consideration irrelevant facts & by treating FIR as gospel truth while granting bail to Ashish. The Supreme Court said High Court also erred by not giving an opportunity to complainants to argue & oppose bail.

On April 4, a bench headed by CJI NV Ramana had reserved the order after hearing all the parties.

Family members of the victims of the Lakhimpur Kheri incident had moved the SC challenging the Allahabad HC order, which granted bail to Ashish Mishra.

In the Special Leave Petition, family members of the deceased challenged the Allahabad HC order dated Feb 10, 2022, wherein Ashish Mishra was granted regular bail. The petitioner said that the Allahabad High Court order is unsustainable in law. They also said that they have approached the Top Court as the State of Uttar Pradesh has failed to prefer any appeal against the impugned order.

Ashish Mishra was released from jail in Feb followed by Allahabad High Court granting him bail. 8 people, including 4 farmers, died in violence on Oct 3, 2020, in Lakhimpur Kheri.

Earlier, the Supreme Court had appointed a committee headed by retired Punjab and Haryana HC Judge Rakesh Kumar Jain to monitor the probe into the Lakhimpur Kheri violence.
