Benchmark can't be lowered for SC and Backward candidates.

Supreme Court today declined to entertain a Public Interest Petition challenging fixation of 45 per cent as the qualification marks for Scheduled Caste (SC) candidates.

Haryana Judicial Service Examination had adopted this minimum marks criterion.

Apex court was of the view that there should always be a minimum marks qualification marks for being a Judge or Judicial Officer.

Bench comprising Chief Justice T.S. Thakur and Justices A.M. Khanwilkar and D.Y. Chandrachud observed that for the purpose of selection of a Judge, there fixation of a minimum qualification is a must. There shall always be a benchmark to become a Judge.

Simply because some one is a Scheduled Caste does not mean that the benchmark shall be done away with.

Court did not agree with the submission of an NGO, Volunteers for Social Justice,demanding further lowering of this 45% qualification benchmark for SC candidates.

In the Petition the NGO had sought to challenge the Punjab and Haryana High Court decision to adopt 45 per cent as the qualification marks for SC candidates.

The same qualification marks were also notified for Backward Caste candidates.

The High Punjab and Haryana Court too had earlier dismissed the plea of the NGO.
