On Monday, the Apex Court dismissed the curative plea filed by Pawan Gupta, 1 of the 4 death row convicts in the 2012 Nirbhaya gangrape & murder case.

A 5-Judge bench headed by Justice N V Ramana, which considered the curative petition in-chamber, also rejected Pawan's application seeking a stay on the execution of death sentence which is scheduled for Tuesday. 

"The application for oral hearing is rejected. The application for stay of execution of death sentence is also rejected. The curative petition is dismissed...," the bench, also comprising Justice Arun Mishra, Justice R F Nariman, Justice R Banumathi & Justice Ashok Bhushan, said.

In his curative petition, Pawan had sought commutation of his death penalty to life imprisonment.

He had also sought a stay on the execution of black warrant issued by the Trial Court for the hanging.

On Feb 17, The Trial Court had on Feb 17 issued fresh date for execution of death warrants for Tuesday at 6 am for the 4 convicts -- Mukesh Kumar Singh (32), Pawan Gupta (25), Vinay Kumar Sharma (26) & Akshay Kumar (31) -- in the case.

The mercy pleas of 3 convicts -- Mukesh, Vinay & Akshay -- have already been dismissed by the President.

The Supreme Court had earlier dismissed separate pleas filed by Mukesh & Vinay challenging the rejection of their mercy pleas by the President.

While Akshay hasn't yet challenged the rejection of his mercy plea, Pawan hasn't yet filed a mercy petition before the President.
