Recently, the Supreme Court disposed of a Public Interest Litigation (PIL) seeking directions to the Municipal Corporation of Delhi and other relevant authorities for granting school admissions to Myanmar and Rohingya refugee children in schools located near their residences. The Court granted the petitioner organisation the liberty to approach the Ministry of Home Affairs for the matter to be decided promptly.

In the present case, the petitioner sought the Court's intervention to ensure that refugee children from Myanmar and the Rohingya community receive admission to local schools in Delhi. The petitioner argued that these children, many of whom had family members already enrolled in government schools, were being denied their right to education.

The counsel for the petitioner highlighted that 18 children had been identified as eligible for school admission, with their siblings already attending government schools in Delhi. The Court, in an attempt to verify the bona fide residency of these families in the areas where the children sought admission, asked for further details from the petitioner.

The Court observed that the proper course of action for these children would be to directly apply to the concerned government schools for admission. Should any such applications be denied, the children could approach the Delhi High Court for relief. The petitioner organisation agreed to provide pro bono legal assistance in case of any denial.

The Top Court disposed of the special leave petition while granting the petitioner the liberty to take necessary steps with the Ministry of Home Affairs. All pending applications related to the case were also dismissed.
