Notice to the occupant of the Brothel, impedes with implementation of Law

On Friday Supreme Court expounded that sex workers though not caught or convicted for the immoral trafficking they could not take shelter of law to resist their eviction from the brothel.

Vacation Bench of the Supreme Court comprising of Justice Pinaki Chandra Ghose and Justice Amitava Roy rejected the submission that sex workers shall be served notice before being evicted from the brothel and held that if notice had to be given to the occupant of the brothel, it would impede with implementation of the provision of Immoral Traffic (Prevention) Act.

The Apex Court was approached by the petitioners against an order of High Court in which it upheld the Session's Court decision of convicting two alleged sex workers and also directing eviction at two other locations.

In a statement, Delhi Commission of Women (DCW) has described the Supreme Court's order of rejection of the petitions as a "positive development".
