July,27,2016:

Former SC judge Justice P V Reddi, recommended that 12 more DJS candidates deserved to be selected as judicial officers.

Delhi High Court had stopped a step short of simultaneously selecting a sitting High Court Justice's daughter and son as Judges, fearing allegation of Nepotism. It selected only the daughter.

But the son too was ultimately selected by the Supreme Court itself in a PIL filed by Prashant Bhushan. Since the PIL questioned the selection process,  a retired SC judge was asked to evaluate the answer sheets afresh.

Actually as against vacancy of 80 posts of of entry level Judges in Delhi, the Delhi HC selected only 15 candidates for appointment after completing the three tier process including -preliminary examination, main exam followed by interview.

The reason why High Court stopped at 15 on the merit list is that 16th rank was that son of High Court Judge.

In order to avoid a hue and cry over selection of a sitting Justice's Two children getting appointed as judges in the Delhi Judicial Service, the HC appointed only upto 15th Rank.

Upon reevaluation former SC judge Justice P V Reddi, recommended that 12 more DJS candidates deserved to be selected as judicial officers.

On the basis of Justice Reddi's findings, the son of the sitting HC Justice also got selected.

Bench of Justices Misra and R F Nariman advised the Delhi HC to accept PIL's two more suggestions, in addition to the couple of suggestions already acceptedso as to bring further transparency into the Judges selection process and eliminate any suspicion.

The suggestions are marking multiple question answer sheets by pen instead of pencil and furnish a copy of the answer sheet to the candidate under RTI Act.

The SC also asked DelhiHC to keep in mind to publish names of selected candidate at every stage of the selection process instead of publishing only their roll numbers.

It also asked Delhi HC to carry out rationalization of marks, in case of strict marking by examiners, as per SC Guidelines.
