Bench said that there are sufficient grounds to allow the application.
On Thursday, Supreme Court modified its earlier order and has allowed the liquor manufacturers from Bihar to export their old stocks of the alcoholic beverages worth over Rs 200 crore outside the state till July 31,2017.
The Apex Court Vacation Bench comprising Justice Ashok Bhushan and Justice Deepak Gupta passed order on application by the manufacturers who had contended that Supreme Court's May 29 order spoke about time to destroy stock but it did not indicate anything about its "export" outside the state.
The Manufacturers submitted before the Apex Court that there were two issues namely destruction of the old stocks and the export in the plea filed earlier and Supreme Court's May 29 order mention only about the time to destroy the stocks.
After brief hearing, Supreme Court Bench expounded that,"sufficient grounds have been made out to allow application" in terms of prayer seeking clarification of earlier order.
According to the Apex Court's, May 29,2017 order, Time to destroy /drain stocks was extended up to July 31, 2017. with no further extensions to be granted.
Bihar Govt. had prohibited consumption, stocking and the sale of liquor in State had on March 30,2017 and had passed a resolution by which it had allowed companies to export their old stocks to the other states.
Government had granted time to export the excisable and the non-excisable articles till April 30,2017 after which they would not be able to do so.
