SC had had earlier said that Jats are not backward socially, educationally or politically.
The High Court of Punjab and Haryana High has today stayed the much Politicised reservation for Jats and five other Castes. They were provided reservation by the Government Haryana by carving out a new Backward Classes (C) category besides other categories already enjoying reservation.
Petition challenging the constitutional validity of newly promulgated Haryana Backward Classes (Reservation in Services and Admission in Educational Institutions) Act, 2016 was being heard by the Bench headed by Justice S S Saron.
This statute was passed by the state Assembly on March 29 unanimously .
Murari Lal Gupta of Bhiwani, has challenged the new Act and he has also sought a direction to quash Category ‘C’ of the Act, which aims to provide reservation to the Jat community.
The plea taken by petitioner before the High Court is that the Jat community has been given reservation under the new Act on the basis of the Report submitted by Justice KC Gupta commission, even though the same has been quashed by the Supreme Court.
It was pleaded and submitted that in the year 2014 as well, the State Government had similarly introduced a similar bill for adding Jats amongst the other backward classes in order to provide reservation in jobs and educational institutions.
But the Supreme Court, while deciding the case titled Ram Singh versus the Union of India, had ruled that Jats are neither backward socially or educationally nor politically.
The newly enacted Act provided reservation to Jats and five other communities under the newly created backward class (C) category.
The five other communities which benefited are– Jat Sikhs, Muslim Jats, Bishnois, Rors and Tyagis. They were provided 10 per cent reservation in Government Jobs and educational institutes.
