The Punjab and Haryana High Court has taken significant steps to ensure the welfare and rehabilitation of rape victims and their children, emphasizing the importance of dignity and support for survivors. Justice Vinod S Bhardwaj, in response to a petition by a sexual assault victim seeking compensation, has issued directives to state governments regarding various measures to be implemented.

One crucial directive from the Court is for the States of Punjab and Haryana, along with the Chandigarh Administration, to issue instructions to all offices, including educational institutions, to refrain from insisting on the father's name of a rape victim's child. The Court highlighted that such insistence can be distressing and counterproductive for the victim and child.

Amicus Curiae Tanu Bedi, who contributed suggestions during the case, played a significant role in shaping these directives. Bedi's recommendations emphasize the need for a comprehensive approach to victim rehabilitation. One of the highlighted measures involves establishing one-stop centers to provide psychological and emotional counselling to victims of all forms of sexual assault, aiding them in overcoming trauma and making informed decisions.

For cases where pregnancy is detected beyond the permissible time limit for termination, Bedi proposed involving the Central Adoption Resource Authority (CARA) or relevant authorities to facilitate swift adoption proceedings immediately after birth. Additionally, if the victim decides to keep the child, the State is expected to offer necessary assistance for the child's proper upbringing.

The Court's directives also extend to shelter homes, where it's proposed that conditions be improved to reflect a more normalized life rather than isolating victims from social interactions under the pretext of security concerns. Importantly, the Court addressed the need for facilities that allow mothers and children to reside together within shelter homes, acknowledging that current setups primarily cater to women or orphaned children.

Furthermore, the Court urged authorities to ensure the implementation of these measures effectively, with a particular focus on the well-being and rehabilitation of both rape victims and their children.
