A special Court at Mumbai rejected the bail of a convict accused under the Protection of Children from Sexual Offences Act after taking into account the testimony of the victim, a 5- year-old, who alleged the accused of sexual harassment.
Case of the accused
The accused informed the Court that he was a distant relative of the victim’s family and the families had a bond wherein the families use to visit each other often. Bail was sought on the grounds that the investigation is completed and the charged sheet is also filed. The accused asserted to concede with all the conditions required for the grant of bail and thus pleaded for the same.
Moreover the accused claimed to be non- guilty for the alleged offence by stating that the victim use to often visit him at his place and that his touch cannot be construed as “ bad touch”.
Case of the Prosecution
The prosecution opposed the application, and prayed to the Court for the denial of the bail, stating that the offences for which the accused is charged of are serious in nature and if the accused in released on bail then he might try to dilute the trial by threatening the victim or he might also commit more offences of such nature.
Observation of the Court
The Court after taking into consideration the relevant facts and details of the present case and the nature of the offences the accused was charge of rejected the bail application.
