Recently, in a proceeding initiated suo motu on a complaint from a woman judicial officer, the Delhi High Court has discharged an advocate from criminal contempt after accepting his unconditional apology for using derogatory and threatening language toward the magistrate during court proceedings.
The Division Bench of Justice Vivek Chaudhary and Justice Manoj Jain noted that the respondent, who is an advocate, had “misbehaved in her Court and intimidated her by using derogatory and threatening language, during the course of judicial proceedings.” The incident, which occurred on March 3, 2025, was reported by Ms Astha Sharma, Judicial Magistrate (NI Act), through a written complaint.
Taking cognizance of the complaint, the Court had treated the matter as criminal contempt and issued notice to the contemnor. During the proceedings, the respondent filed an affidavit expressing “his ‘unconditional apology’ for the alleged conduct and behavior and sought forgiveness and discharge from the present contempt proceedings.”
The Bench had further directed the lawyer to appear before the concerned magistrate and personally tender a written apology. The order records that the Judicial Officer, in her report, confirmed that the contemnor “appeared before her on 18.09.2025 and tendered written apology for his said conduct.”
Taking the report on record, the Court observed that the contemnor “reiterates his unconditional apology for his said conduct and behavior and undertakes to be very careful in presenting himself before the Court, during the course of any judicial proceedings. He assures that he would always maintain the decorum and dignity of Court and would not repeat such act in future.”
Accepting the apology, the Bench concluded, “In view of the above, this Court, while accepting the abovesaid unconditional apology, discharge the respondent – contemnor from the contempt proceedings. The contempt proceedings stand closed accordingly.”
