In a big relief for Manish Maheshwari, Managing Director of Twitter India, Karnataka high court on Thursday passed an interim order restraining the Uttar Pradesh police from initiating any coercive action against him vis-a-vis Ghaziabad police’s ongoing probe into the circulation of a communally sensitive video clip of an elderly Muslim man being attacked.

Justice G Narendar however has said that if the police want to interrogate him, they can do so via virtual mode and adjourned the hearing to June 29 , observing that the matter requires consideration.

Earlier, senior advocate CV Nagesh, who appeared for Manish claimed that the petitioner has nothing to do with the said video clip and he is only an employee of the company

He further argued that the police had earlier issued a notice under section 160 of CrPC on June 17 for which he had replied and thereafter issued a notice under section 41-A of CrPC ,asking him, a resident of Bengaluru, to report at Loni Border police station, at 10.30 am on June 24, so as to get his statement recorded in the case.

He claimed that the very notice itself is without jurisdiction and there is a possibility of arrest of the petitioner as well.

On the other hand, P Prasanna Kumar, Special Public Prosecutor for UP police contented that the petition itself is not maintainable in the first place as the petitioner is a resident of Mumbai .

He further argued that the police have called him to record his statement ,in furtherance of ongoing investigation.
