The Motor Accident Claims Tribunal (MACT) in Thane has ordered a compensation of Rs. 62.19 lakh with 9% interest to the family of a 39-year-old man who lost his life in a tragic road accident involving a speeding milk tanker.
MACT Member R.V. Mohite, in an order, directed the tanker owner and its insurer, The New India Assurance Company, to pay the compensation jointly and severally. The order copy was made public on Sunday.
The Case arose from the 2019 collision on the Kalyan-Nagar Highway, when Mohan Shiroshe, driving his car, was hit by a tanker that veered to the wrong side of the road. The impact spun his car into another vehicle. Though rushed to the hospital, Shiroshe succumbed to his injuries, while the tanker driver fled the scene.
The victim’s family, represented by Advocate P.M. Tillu, had sought ₹1 crore compensation, attributing the accident solely to the tanker driver’s rash driving. The insurer, represented by Advocate K.V. Poojari, contested the claim, alleging both that the tanker driver lacked a valid licence and that Shiroshe himself was negligent.
After examining the evidence, the tribunal ruled that the tanker driver bore 80% responsibility, while Shiroshe was 20% contributorily negligent. It also rejected the insurer’s argument of policy breach, noting that no proof was produced to establish the absence of a valid licence or permit.
The compensation was calculated based on Shiroshe’s annual income, with additions for future prospects and deductions for personal expenses.
