The Kerala High Court has dismissed a Habeas Corpus petition filed by the father of Dr. Akhila, also known as Hadiya, alleging her disappearance and the inability to establish contact with her for the past month.

The Court's decision was grounded in Hadiya's submitted statement, wherein she conveyed that she had undergone divorce, remarriage, and presently resides in Trivandrum. Accompanying her statement were call records, evidencing consistent communication with her parents. Additionally, she provided the Court with specific details regarding her current address and contact information.

A division bench comprising Justice Anu Sivaraman and Justice C. Pratheep Kumar concluded that Hadiya is not subject to any illegal detention, rendering the Habeas Corpus petition non-maintainable. The Court stated that Hadiya is leading a life of freedom and is not under any illegal custody. This legal determination reaffirms Hadiya's autonomy and dispels claims of her being unlawfully restrained.

Background: Born into a Hindu family in Kerala, Hadiya converted to Islam during her studies in Tamil Nadu and subsequently married Shafin Jahan. In 2016, her father filed a habeas corpus plea challenging this marriage. The Kerala High Court annulled their marriage asserting concerns about love jihad.

March 2018 witnessed a development when the Supreme Court restored Hadiya's marriage and permitted her to live with her husband.
