A now 32-year-old man found guilty of running over a resident in his Vile Parle building in 2012 has been let off on a bond of good behaviour after he told the court that he was recently married, had responsibilities & that he was a first-time offender. The victim was sitting on a bench when he was left fatally injured.

The accused was held guilty of causing death by negligence & rash & negligent driving. Salman Bhaldar drove the car despite not having a licence.

Metropolitan Magistrate CP Kashid said, “The entire record of case & rozanama shows that accused continuously present in the court of each date of hearing. The accused has been held guilty for the offence which is not punishable for death sentence or imprisonment for life. Previous conviction of the accused has not been proved. Therefore, I wish to give benefit of Probation of Offenders Act to the accused".

Under the Probation of Offenders Act, an accused can be released on a bond of good behaviour instead of serving a sentence. The accused may have to spend time in jail if he violates the Court’s conditions relating to good behaviour & maintaining peace.

The Magistrate said that “Instead of sentencing him, be released on his entering into a bond of Rs 10,000, to appear & to receive sentence when called upon during the period of one year from the date of judgment & in the mean time to keep the peace & be of good behavior".

The maximum sentence attracted in the case was 2 years’ imprisonment. The Court also directed the accused to pay Rs 5,000 compensation to the son of the victim, Mahesh Patkar. The eyewitness submitted that on Nov 26, 2012, at about 7.30 pm, when he was between 2 buildings in the complex, a car came from the front & rammed into Patkar who was siting on concrete bench. He said that it was one-way & many people used to sit there in the evenings. The witness said he heard Patkar screaming.
