On Wednesday, A Delhi Court directed the city police to furnish a copy of the first information report (FIR) to Rajesh Bhai Khimji Bhai Sakariya, the man accused of attacking Delhi Chief Minister Rekha Gupta during a public grievance session last month.
The Case arose from the incident on 20 August 2025, when Sakariya, a 41-year-old autorickshaw driver from Rajkot, allegedly posed as a complainant before assaulting the Chief Minister at her Civil Lines residence. He was arrested soon after and charged under provisions relating to attempt to murder, assault on a public servant, and obstruction of official duties.
Sakariya had moved the Court contending that the police had failed to provide him with a copy of the FIR. The Delhi Police opposed the plea, claiming the FIR had been classified as “sensitive” under an internal order. It was further argued that the application was premature and not maintainable.
The Special Public Prosecutor submitted that the FIR could be given if the accused undertook not to circulate it further. Counsel for the accused, however, countered that no such undertaking is contemplated under the law.
Judicial Magistrate First Class Gaurav Goyal invoked the settled position of law on the rights of an accused, observing that “according to the Supreme Court's judgment, an accused should be provided a copy of the FIR.”
Allowing Sakariya’s application, the Court ordered, “In view thereof, the instant application is allowed and IO concerned is directed to supply the copy of FIR within 24 hours against due acknowledgment. Application stands disposed of. Accused is also directed not to publish, circulate or disseminate the contents of the FIR in the public domain or to any third party without the permission of this court.”
Rejecting the police’s resistance, the Court directed the supply of the FIR copy within 24 hours, subject to the express condition that its contents shall not be disclosed without prior leave of the court.
