On Thursday, the Allahabad High Court, issued a bailable warrant against Ms. Jasjit Kaur, District Magistrate of Bijnor and Chairman of the District Level Caste Scrutiny Committee, for failing to respond to Court notices in a contempt proceeding. The Court directed that the warrant be executed through the Chief Judicial Magistrate, to ensure her presence at the next hearing scheduled in the week commencing January 5, 2026.
The matter arose from a writ petition filed by Vikram Singh, seeking determination of his caste status. Earlier this year, a Division Bench of the High Court disposed of the writ, directing the petitioner to approach the District Level Caste Scrutiny Committee for verification. The Court emphasized that the Committee must “keep in mind the decision of the Hon’ble Supreme Court in Kumari Madhuri Patil and another Vs. Additional Commissioner, Tribal Development” and mandated that the inquiry by the Vigilance Officer be conducted as part of the process. Further, the Committee was instructed to dispose of any application filed within fifteen days within a period of three months.
Despite these clear directions, the petitioner alleged non-compliance, particularly pointing to the absence of a vigilance inquiry. A Single Judge had issued a notice to Ms. Kaur in September 2025, requiring her to show cause “as to why the proceedings for contempt of the Court be not initiated against [her] for non-compliance of the judgment and order dated 22.04.2025.”
Advocate Vipul Shukla, representing Vikram Singh, submitted that the respondent District Magistrate failed to take any action to comply with the High Court’s order. Specifically, it was highlighted that Ms. Kaur did not contact the Office of the Chief Standing Counsel after receipt of the notice, leaving the compliance affidavit unfiled and delaying the process.
The Court observed that "As per office report dated 04.11.2025, notice was served upon the respondent for 06.11.2025 and thereafter, the case was listed on 06.11.2025, on that date, learned Standing Counsel prayed for and was granted two weeks' time for filing compliance affidavit but he has informed that the respondent has never ever contacted the Office of the Chief Standing Counsel after receiving the notice. Let the bailable warrant issued to the respondent through C.J.M, Bijnor for ensuring his presence before this Court by the next date of listing."
The Court scheduled the next listing in the week commencing January 5, 2026, emphasizing the necessity of personal compliance by the District Magistrate.
In light of the respondent’s non-response, the Court directed issuance of a bailable warrant through the Chief Judicial Magistrate. The order ensures judicial oversight over the execution of the Court’s previous directions regarding caste verification and vigilance inquiry, reinforcing that non-compliance with judicial orders may attract stringent measures.
