The Delhi High Court has granted bail to a man who allegedly refused to stop his vehicle at a police checkpoint and speeding away his car with a police officer on its bonnet.

As per the FIR, the complainant, a head constable, along with two others, was carrying out routine checking in the Hari Nagar area on June 22 this year when the accused refused to stop his car and suddenly sped away, as a result of which the car hit ASI who fell on the side of the road. It was stated that the complainant tried to stop the car from the front and jumped on its bonnet but the petitioner did not stop the car.

The accused surrendered in July 2021 and sought his release on the grounds that the investigation was over.

Delhi High Court Justice Subramonium Prasad in the case titled Rohit Sharma v. State NCT of Delhi has held that no doubt the petitioner is charged with an offence under Section 307 IPC and if convicted, the petitioner may be sentenced for life, but that alone cannot be a factum to keep the petitioner in incarceration. The petitioner is an engineering graduate having roots in society. Most of the witnesses are police witnesses and the petitioner would not be able to influence them. The evidence has already been collected and the chargesheet shall be filed shortly. In view of the above, this Court is of the opinion that no useful purpose would be served in keeping the petitioner in custody. Accordingly, High Court grants bail to the Petitioner subject to him furnishing a bond of Rs. 75,000 with two sureties of like amount.
