On Tuesday, Twenty years after an MSRTC bus hit a scooter and left the rider "permanent partially disabled", the Bombay high court has enhanced his compensation five times.
While Thane's Randhir Sharma received Rs 4 lakh inclusive of a no fault liability of Rs 25,000 with 7.5% annual interest, HC has enhanced the amount to more than Rs 20 lakh.
Justice Ramesh Dhanuka pronounced via videoconference his verdict on Sharma's appeal against the July 26, 2005, award and judgment of the Motor Accident Claims Tribunal, Mumbai, partly rejecting his Rs 10 lakh claim.
In 2000, Sharma, then 36, was a motor mechanic who made Rs 5,000 per month. On April 25, 2000, he was riding his scooter at Kasheli bridge when a speeding ST bus hit him from behind and he fell in front of the vehicle. He was taken to Thane Civil Hospital where his left hand was amputated above the elbow. MSRTC denied its driver's negligence. In 2007, Sharma moved HC against MACT order.
The judge said the tribunal could not have assessed his disability at 75% and ought to have accepted the surgeon's certificate that it was 95%.
Noting that MACT had not considered any amount towards his future prospects, the court directed enhancement of the compensation amount and related claims to Rs 20.3 lakh.
