A Calcutta High Court bench comprising Justice Tirthankar Ghosh, while dealing with the Mithun Chakraborty case regarding inciting post-poll violence in the state of West Bengal, has directed him to be available for the purpose of interrogation and directed the investigating officer to provide reasonable time to the petitioner to appear via video conference.
Background of the Case
It was alleged that Mithun Chakraborty, during a BJP rally at Brigade Prade ground, Kolkata uttered dialogues from his Bengali movie, namely, "marbo ekhane lash porbe shoshane” and "ek chobole chabi” meaning “I will hit you here and the body will fall in the crematorium” and “just one snakebite and you will become a photograph” respectively. After this, on 6th May 2021 a member of TMC filed a case alleging that these dialogues cause post-poll violence in the state, therefore, he is liable for inciting violence in the state. Thereafter, in this incident, a case was registered u/s 153A, 504, 505, 34 of IPC.
In response to this Chakraborty filed a petition seeking quashing of these proceedings before the Calcutta High Court stating that he has no motive of inciting violence those dialogues were just for recreational purposes and stated that he was innocent and had no nexus with the post-poll violence issues.
Order of the Court
Court perused the complaint which was the genesis of the FIR. In view of the accommodation sought for by both sides, the Court fixed the matter to be heard on June 18, 2021, as a motion.
Furthermore, in the meantime, the Court stated that the petitioner or his advocate-on-record would communicate the e-mail address of the petitioner to the State so that for the purposes of interrogation or answering any query of the investigating officer, the petitioner can make himself available by way of video-conference.
The Court directed the investigating officer to, at least afford the reasonable time to the petitioner for his appearance by way of a video conference. The petitioner was also directed to effect service on learned advocate Mr. Dipanjan Dutta, who submitted that he has been engaged by the second opposite party to participate in the instant case.
