A Division Bench of the Madras High Court, comprising of Justice T. S. Sivagnanam and Justice S. Anathi in the case of T. Ramasamy v. The Government of India & Ors. has dismissed the petition seeking a direction to educate Tamil Nadu people, to respect the country India, by calling its name as it is in the official writings by declaring the petition as highly misconceived.

The Bench held that,

“the prayer sought for is thoroughly misconceived and no such direction can be issued by this Court directing the State Government or the Hon'ble Chief Minister to speak in a particular fashion.”

Factual Background

The petitioner is an Advocate practicing before this Court and the Courts in Dindigul District and he seeks for a direction upon the Respondent to educate the people in the State of Tamil Nadu, to respect the country India or Bharath, by calling its name as it is in the official writings and speeches by adhering to patriotism, sovereignty, and respect, by taking note of his representation dated 15.06.2021.

Therefore, he filed Writ Petition under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the 1st and 2nd respondents to educate its one of the state, Tamilnadu to respect our country India or Bharat by calling its name as it is in their official writings and speeches by adhering patriotism, sovereignty, and respect based on the petitioner's representation.

Court Reasoning & Judgment

The Court considered the petitioner’s prayer to educate the State Government or the Hon'ble Chief Minister, to respect the country India or Bharath, by calling its name. The Court was of the view that,

“in our considered view, the prayer sought for is thoroughly misconceived and no such direction can be issued by this Court directing the State Government or the Hon'ble Chief Minister to speak in a particular fashion.”

The Court further held that the prayer is absolutely vague as to what sort of education to be given to the people of the State of Tamil Nadu. Therefore, The Court disposed of the petition and declared that the relief sought for in this writ petition is misconceived.
