On Thursday, a Georgia judge dismissed two criminal charges in the 2020 election interference case against Donald Trump, ruling that state prosecutors lacked authority to file them. However, eight charges, including racketeering, will proceed. Trump and 14 others have pleaded not guilty, with prosecutors alleging a scheme to overturn Trump’s Georgia election loss.
The case has been delayed pending a court decision on whether District Attorney Fani Willis should be disqualified over alleged misconduct. Meanwhile, a related federal case has been showed by a Supreme Court ruling on presidential immunity.
Thursday's ruling specifically addressed claims that Trump and his associates organized a fraudulent slate of presidential electors and filed a lawsuit with false allegations challenging the election results. This decision means that five of the original 13 charges against Trump have been dismissed, with McAfee previously throwing out six others, including three against Trump, in March.
Trump’s lawyer, Steve Sadow, welcomed the decision, stating that Trump and his legal team had once again "prevailed." A response from the office of District Attorney Willis was not immediately available. In a separate ruling, McAfee upheld the racketeering charge, which applies to all defendants involved in the case.
