The Enforcement Directorate (ED) has withdrawn the summons issued to Senior Advocate Pratap Venugopal in connection with its investigation into the Employee Stock Option Plan (ESOP) granted by Care Health Insurance to former Religare Enterprises Chairperson Rashmi Saluja. The development follows growing concerns within the legal community regarding the potential encroachment on the principle of lawyer-client confidentiality.
The summons issued to Senior Advocate Pratap Venugopal were tied to his role as Advocate-on-Record for a legal opinion authored by Senior Advocate Arvind Datar. The opinion had endorsed the legality of the ESOPs extended to Saluja. The ED had previously issued a similar summons to Arvind Datar, which was later retracted without further action.
On the morning of June 20, the Supreme Court Advocates-on-Record Association (SCAORA) addressed a letter to Chief Justice of India BR Gavai, expressing grave concern over the ED’s issuance of summons to Venugopal. In a letter signed by SCAORA President Vipin Nair, the association described the action as “a deeply disquieting development” and cautioned against the ramifications such actions might have on the legal profession.

SCAORA asserted that Venugopal, who was designated as Senior Advocate earlier this year, “is a widely respected member of the legal fraternity,” and argued that the ED’s approach constitutes “an impermissible transgression of the sacrosanct lawyer-client privilege.” The letter further warned that “such coercive measures could have a chilling effect on the legal community.”
No judicial observation has been made public as of the issuance of this report. However, the letter to the Chief Justice was framed in terms calculated to draw judicial attention to the potential infringement of professional independence and confidentiality obligations that govern the legal profession.
Although the matter did not culminate in a formal adjudication, the ED has voluntarily withdrawn the summons issued to Venugopal. The withdrawal comes in the wake of the representation by SCAORA and mirrors the earlier retraction of the notice issued to Senior Advocate Arvind Datar.
