Despite being “highly educated and practising a noble profession”, Germany-based doctor has been said to assaulted his Doctor wife, in a series of incidents.

Viewing the case, a Magistrate Court has ordered him to pay total monthly maintenance of ₹60,000 to her and their five-year-old child.

He was also directed to pay ₹5 lakh as compensation for the mental, emotional and financial violence the wife suffered.

“It is very relevant to mention here whether it is expected of a person who is highly qualified and in a noble profession to cause any kind of violence to his wife. The evidence of the applicant (woman) reveals not only a single incidence of violence but a series of it,” the Court said.

Among the allegations, the woman told the court that her husband kicked her in the stomach when she was pregnant and even locked her out in the balcony at midnight. She further stated her in-laws had prohibited her from breastfeeding her infant and had attempted to coerce her to leave the child behind and to go to Europe to find a high-paying job.

She said they had even abused her and called her a “slum girl from Mumbai” and demanded her salary. The woman said she then began to deposit money in their joint account.

On examining the facts, Court found substance in the woman’s allegations and thus stated, “It is pertinent to state here that a mother cannot leave to go abroad without her small baby for the purpose of earning. Furthermore, depriving a mother of breastfeeding is an insult of her motherhood. These acts on the part of respondent number three (mother-in-law) certainly fall under the definition of mental and emotional abuse.”
The court said, “The mere fact that the spouse with whom the child is living has a source of income, even if sufficient, would in no way absolve the other spouse of his obligation to make his contribution towards the maintenance and welfare of the child.”

The couple met in 2010 after connecting on a matrimonial site. While the man is now based in Europe, the woman lives in the city with their child and works for a reputed hospital. In 2015, she submitted a complaint against the man and his septuagenarian parents.

She sought relief under the Domestic Violence Act. Her father-in-law is a doctor too. She said at the time of her marriage, her father had given ₹25 lakh to her in-laws.

The woman said that her husband had ignored her from the beginning and was having an affair with a colleague. The woman said in the year that they lived apart due to their work commitments, her husband did not contact her.

She said he always introduced her as an engineer because she had completed her post-graduation and was senior to him. The woman said the man used to justify his affair and assault her when questioned. She said the torture continued when she became pregnant in 2012.

The woman further said she was tortured for not preparing food in coconut milk and forced to pray all day. In 2014, she left him and went back to her parents. The man and his parents have denied the allegations.
