The Division Bench of the Delhi High Court in the case of Anil Kumar vs High Court of Delhi consisting of Justices Amit Bansal held that as per Delhi Higher Judicial Services Rules, 1970, rounding-off of marks at any stage of the examination was not permissible.

Facts

The petitioner could not clear the DHJS (Mains) Examination and was declared unsuccessful solely for the reason that the marks secured by him in Paper-I (GK and Language) were below the specified threshold of 45%. The petitioner obtained 67 marks out of the maximum of 150 marks and, therefore, failed to meet the threshold required for being admitted to the next stage of the examination – viva voce. It was the petitioner’s case that none of the marks awarded against his answers were in fractions; therefore, his marks for Paper-I were required to be rounded off.

Observations by the Court

The Bench noted that it would have acceded to the said request of the petitioner but as per Delhi Higher Judicial Services Rules, 1970, rounding-off of marks at any stage of the examination was not permissible:

“No request for rounding-off of marks at any stage shall be entertained and the same shall be liable to be rejected without any notice to the candidates.”

Judgment

The Bench concluded that in view of the specific provision, this Court was unable to grant the relief as sought for by the petitioner and dismissed this petition with “equally heavy hearts”.
