In a significant development concerning intellectual property rights, the Delhi High Court has intervened in the case involving the trademark "JACK DANIEL’S," granting an interim stay on its registration by Indian firm Mangalam Krupa. The Court’s order, issued on December 4, 2024, followed a legal challenge brought by Jack Daniel’s Properties Inc., the renowned U.S. alcohol manufacturer, which alleged trademark infringement.
Jack Daniel’s, a name synonymous with premium whiskey, has been using the trademark "JACK DANIEL'S" since 1895, and it has become an iconic global brand, including in India where it has been in the market since 1997. The company argued that Mangalam Krupa’s registration of the mark under the pharmaceutical and veterinary category — granted in 2023 on a 'proposed to be used' basis — was an unlawful attempt to appropriate the goodwill attached to the well-established brand.
The crux of Jack Daniel’s argument rested on the potential for confusion and deception among consumers. The company claimed that allowing Mangalam Krupa to use the "JACK DANIEL'S" name for non-alcoholic goods would likely dilute the brand’s distinctiveness and mislead the public into associating the pharmaceutical products with the famous alcoholic beverage. Furthermore, Jack Daniel’s contended that such registration could cause irreparable harm to its reputation and the value of its brand, which represents a multi-billion-dollar enterprise.
Justice Amit Bansal, while granting the interim stay, ruled that there was a clear prima facie case in favor of the petitioner. The judge emphasized that the registration of the mark by Mangalam Krupa was likely to violate provisions of the Trade Mark Act, particularly Sections 9(2)(a) and 11, which prohibit marks that deceive or cause confusion among the public.
In light of these concerns, the Court determined that the balance of convenience favored Jack Daniel’s, ordering the suspension of the trademark registration until further proceedings. The matter will be revisited on March 26, 2025.
