In a significant legal development, the Delhi High Court has delivered a verdict that reaffirms the sanctity of settlement agreements and upholds the integrity of legal undertakings.
High Court Bench headed by Justice Manmeet Pritam Singh Arora sentenced a woman to one-month imprisonment for contempt of court after she willfully violated the terms of a mutually agreed settlement with her estranged husband for a one-time divorce resolution.
Brief Facts:
The couple, who got married in 2015 but faced irreconcilable differences leading to separation in 2017, had reached an amicable settlement. This agreement included the husband transferring a property in Mumbai to the wife and the wife agreeing to pay maintenance charges amounting to over ₹13.48 lakh. The terms were crystal clear – failure to adhere to the agreement would result in legal action under the Contempt of Courts Act.
However, within two months, the wife deviated from the agreement's terms, insisting on additional conditions and refusing to approve the property transfer. Her actions prompted the husband to move a contempt plea against her.
Contentions of the Parties:
Advocating for the husband, his representative, Advocate Prabhjit Jauhar, asserted that the wife deliberately and willfully defied the settlement agreement, which he argued constituted contempt of court. Jauhar further contended that the wife's actions were motivated by a desire to secure additional financial benefits from the situation, as evidenced by her refusal to accept the Gift Deed and her insistence on introducing extra conditions. He also claimed that the wife's failure to withdraw legal proceedings, as agreed upon, amounted to an abuse of the legal process.
On the other side, the wife's legal team countered these claims by emphasizing her need for document verification before accepting the Gift Deed. They argued that her stance was grounded in legitimate concerns regarding the proper verification of ancillary documents. Moreover, the wife's lawyers highlighted her financial struggles, asserting that her decision to renege on the settlement agreement stemmed from her inability to fulfill financial obligations due to her own financial constraints and those faced by her aged parents. Additionally, the wife's legal team contended that legal proceedings should only be withdrawn after the divorce decree is granted and the Gift Deed is executed, differing from the husband's position on simultaneous withdrawal.
Observations of the Court:
Justice Manmeet Pritam Singh Arora, presiding over the case, expressed his concern over the wife's open refusal to abide by the terms of the settlement agreement and her lack of remorse for her actions. The court's ruling emphasized that such behavior cannot be tolerated as it undermines the credibility of legal proceedings and the commitments made therein. The woman's deliberate non-compliance was seen as an attempt to exploit the situation to her financial advantage.
The court found her stand to be a direct breach of the settlement agreement and a willful disregard for the court's authority.
Decision of the Court:
The court's ruling imposed a ₹2,000 fine on the wife, in addition to the one-month imprisonment sentence. Failure to pay the fine would lead to an additional 15 days of imprisonment. The court, however, allowed a two-week window for the wife to rectify her stance. If she complies with the terms and conditions of the agreement, withdraws the legal proceedings she initiated, and tenders an unconditional apology, the sentence could be revoked.
