In a recent development, the Mumbai Sessions court has issued a temporary injunction prohibiting a woman lawyer from entering the office of a male lawyer in Mumbai. Judge Virendra Kedar ruled in favor of the male lawyer, stating that no person has the right to enter his office without permission, causing interference with his work.

Judge Kedar emphasized the balance of convenience, highlighting that if the temporary injunction was not granted, the plaintiff would suffer irreparable losses that could not be compensated monetarily. The male lawyer, acting as the plaintiff, had filed a notice of motion seeking the injunction against the defendant, the woman lawyer, to prevent her from entering his office premises. The plaintiff also sought to restrain the defendant from disclosing or sharing valuable intellectual property belonging to him or his clients, which the defendant allegedly obtained unlawfully.

The legal dispute between the two lawyers has been ongoing, with cases filed against each other. The plaintiff claimed that in March 2021, while he and his wife were hospitalized due to Covid-19, the defendant contacted him seeking personal assistance. In April, the plaintiff met the defendant in the court barroom, where, according to him, the defendant expressed her love for him. Despite his attempts to dissuade her and clarify his marital status, the defendant allegedly entered his office, prompting the plaintiff to seek an urgent hearing and file the notice of motion. The plaintiff also lodged a complaint with the police regarding the matter.

During the court proceedings, the defendant appeared in person but did not submit a reply to the notice of motion. The judge noted that there was no evidence on record to challenge the plaintiff's submissions.

This case highlights the issue of harassment and unwanted advances within the legal profession. The court's decision to grant the temporary injunction signifies the recognition of the plaintiff's concerns and the need to protect his work environment. The restraining order aims to ensure that the defendant refrains from entering the plaintiff's office premises and from disclosing any confidential information.
