Consumer commission ruled that customer has the right to know that they will be charged with additional cost for carry bags and also about other specifications and price of the carry bags before the customer makes the selection of goods from the store. Further it was stated that stating the price of goods at the time payment of goods on the cash counter will amount to an unfair trade practice under the Consumer Protection Act 1986 and 2019.
Case of the Complaint
Kumar had challenged the additional cost of Rs. 3 which was charged by More Megastore in Hyderabad for paper carry bag after the purchase of the goods. Further he contended that the logo of supermarket was printed on the bag and it was being used as “their advertisement agent”
Case of the Opposite Party
Counsel for the super market submitted that there is no law stating that there can be no charge of additional cost for the carry bags given to the customers, it was also stated that “the sale of plastic carry bags is not a forcible sale rather it is an option for the complainant”.
Observation of the Consumer Commission
After taking into consideration all the material on record, the Commission held that “disclosing the price of carry bags at the payment counter seems to be undoubtedly an “unfair tradepractice”. It also held that every consumer has the right to know about the ‘additional charges’ which have been added for purchasing the carry bag.
Further it was ruled that by selling the plastic bags having their company logo, the outlet was using the complaints as tool for their advertisement which is an unfair trade practice. “Disclosing the price of carry bags at the payment counter seems to be undoubtedly an “un fair trade practice” under Section- 2(1) (r) of the Consumer Protection Act, 1986.
