Claims that the Bench headed by CJI Thakur had 'a Prejudiced Approach' in the matter.
A petition has been filed by BCCI in the Supreme Court which seeks review of the Apex Courts verdict of July 19 in which most of the recommendations of the R M Lodha Panel on reforms in the cricketing body, saying that the bench headed by Chief Justice T S Thakur had “a prejudiced approach” against BCCI and he should also recuse from hearing the matter.
The BCCI has also contended that the judgement was un-reasoned and also seeks to frame legislative measures for private autonomous society in a field which is already occupied by the legislation, both Parliamentary and state.
BCCI further stated that the judgment authored by CJI and Justice F M I Kalifulla (retired) has neither noted the contentions and the facts correctly, nor dealt with the same.
The most important aspect of the review petition demands an open court hearing, and also plea for recusal of CJI Thakur from hearing it alleging that there is “prejudiced approach” against the BCCI.
The Supreme Court-Appointed Lodha Committee had on January 4 recommended sweeping reforms and an administrative shake-up at the troubled BCCI. The Apex Court had also accepted the recommendations of the Committee headed by retired Chief Justice of India Justice R M Lodha to have a CAG nominee in BCCI.
The bench had, rejected BCCI’s objection against recommendations for one-state and one-vote and had said that the States like Maharashtra and Gujarat who have more than one cricket associations will have voting rights on rotational basis.
