The Gujarat High Court expressed strong disapproval towards the state traffic authorities and the Ahmedabad municipal authorities for their failure to enforce traffic laws effectively. The division bench, comprising Justices A S Supehia and M R Mengedey, highlighted the rampant violations of traffic rules, leading to the tragic accident on SG Highway where nine people lost their lives and 13 others were injured.
The court remarked that the authorities' lack of action in punishing traffic offenders has emboldened them to violate the law with impunity. Justice Supehia addressed the government pleader representing the traffic police, stating, "You don't have the spine to implement the traffic laws. Neither do you have the will to implement it." The bench criticized the authorities for being mere spectators at a crossroads, failing to take necessary action against offenders.
The court emphasized the need for a regular and stringent mechanism to enforce traffic rules and regulations rather than occasional temporary drives. It urged the authorities to create a sense of fear among lawbreakers, ensuring that they face strict consequences for their actions. The bench also expressed concern over the long-pending litigation on the matter and the state's failure to implement traffic laws despite directions issued by the court in 2006 and 2018.
Initially considering contempt charges against the municipal commissioner and traffic commissioner, the court granted them an opportunity to demonstrate tangible action and results by August 9. However, it warned that failure to show improvements could result in the initiation of contempt proceedings. The court's frustration was evident, as it emphasized that the loss of lives due to traffic accidents could have been avoided with timely and proactive enforcement of traffic laws.
The Gujarat High Court urged the authorities to take inspiration from cities like Delhi and Mumbai, where traffic implementation is strict and efficient. It emphasized the importance of technology and regular checks to manage traffic effectively and ensure the safety of citizens. The court emphasized that it would closely monitor the authorities' actions and demanded immediate steps to improve traffic regulation and management in Ahmedabad city.
