Today, in an unusual development at Rashtrapati Bhavan, a moment of quiet institutional courtesy unfolded immediately after the swearing-in of the new Chief Justice of India. The event, ceremonial on its surface, raised an interesting point about protocol, continuity of office, and the understated customs that accompany transitions at the highest level of the judiciary.

The occasion concerned the elevation of Justice Surya Kant as the 53rd Chief Justice of India, following the retirement of Justice B.R. Gavai on November 23. Justice Kant took the oath on Monday morning before the President of India, pledging allegiance in Hindi. Senior constitutional authorities, including the Vice President, the Prime Minister, and the outgoing Chief Justice, attended the ceremony. Upon demitting office, Justice Gavai arrived at Rashtrapati Bhavan in the official Mercedes-Benz vehicle assigned to the CJI. After the swearing-in, he made a noteworthy choice, leaving the official car behind for his successor and returning home in his personal vehicle.

According to an individual familiar with the development, the practice was deliberate. It was stated that “after the oath ceremony, Justice Gavai left the official vehicle designated for the chief justice and returned in an alternative vehicle… ensuring that the official car is available for use by his successor for going to the Supreme Court.”  No competing claims or disputes were reported regarding the use of the official vehicle. Rather, the account reflects a voluntary decision rooted in propriety and respect for institutional continuity.

The presence of constitutional authorities, coupled with the orderly transfer of official resources, reflects the emphasis placed on ceremonial precision, administrative clarity, and the dignity attached to the office of the Chief Justice of India. The act of leaving the official car at the venue, although not mandated by any written protocol, mirrors the quiet discipline with which constitutional transitions are expected to proceed.

Justice Surya Kant formally assumed office as the 53rd Chief Justice of India and will serve a tenure of nearly 15 months, demitting office on February 9, 2027.
