1. While issuing notice, this Court, on 22nd of January, 2007, passed the following order :- "Let a limited notice be issued on the question of payment of back wages. He has already been reinstated and the question is only regarding back wages.
The payment of back wages is stayed."
2. After service of notice on the respondent employee, learned counsel has already entered appearance on his behalf.
3. We have heard learned counsel for the parties and in view of the admitted fact that the respondent has already been reinstated and notice has been issued limited to the question of back wages, we modify the order of the High Court only to the extent that the respondent shall be entitled to back wages for a total sum of Rs. 40,000/- from the appellant, which shall be paid to the respondent within three months from the date of supply of a copy of this order. If such amount is paid and/or deposited, the respondent shall be entitled to withdraw the same without furnishing any security.
4. With these directions, this Special Leave Petition is disposed of. There will be no order as to costs.
