1. Mr. Sanjay Kumar Chandel, learned counsel for the revisionist.
2. The instant revision has been preferred against the order granting maintenance to the respondent/wife at the tune of Rs. 10,000/- per month.
3. As per the office report the revision is well within time.
4. Admit.
5. It is argued by the learned counsel for the revisionist that the monthly salary of the revisionist is Rs. 18,792/-, and therefore, amount towards maintenance, as granted by the Family Court, is on higher side. He also submits that the Family Court wrongly draw a finding about monthly salary of the revisionist i.e. Rs. 58,000/-, which is based on presumption since saving account of the revisionist reflects total figure of Rs. 58,000/- in March 2025.

Learned counsel for the revisionist submits that the salary slip was also placed before the Family Court as paper no. 35B/25 but the same was completely overlooked and the finding has been drawn on the basis of the total deposit in saving bank account. It is further argued that without any reason, the respondent- wife is living separately though the respondent as on date is intended to restore his matrimonial life.

9. List this matter on 20.04.2026.
10. In the meantime, the order impugned dated 28.01.2026 passed by the Principal Judge, Family Court Haridwar shall remain stayed subject to this condition that the revisionist shall pay monthly maintenance of Rs. 7,000/- instead of Rs. 10,000/- to the respondent/wife.
11. On the date fixed, the parties shall remain present in Court in order to settle their disputes.
