The appellant proposes to challenge the judgment and order dated 20.12.2025, passed in Special Sessions Trial No.27 of 2019, State Vs. Pawan Kashyap and Others, by the court of Special Sessions Judge (NDPS Act), Pithoragarh. The appeal is delayed by 06 days. A Delay Condonation Application, IA No.3 of 2026, has been filed.

Learned counsel for the appellant submits that the appellant could not get proper legal advice, due to which there is a delay; the appellant has been provided legal assistance at the expenses of State.

The delay condonation application is not objected to by learned State Counsel.

Having considered, we are of the view that there are good grounds for condonation of delay. Accordingly, the Delay Condonation Application deserves to be allowed.

The delay condonation application is allowed.

The delay in preferring the appeal is condoned.
