3. The present Criminal Misc. Application filed under Section 528 of BNSS has been filed by the applicant for quashing the chargesheet dated 25.05.2024, summoning/cognizance order dated 12.07.2024 passed by learned Additional Chief Judicial Magistrate, Kashipur, District Udham Singh Nagar in Criminal Case No. 2295 of 2024, State Vs. Subodh Kumar Singh, under Section 420 IPC and the entire proceedings arising out from it.

4. The applicant served as Principal in Little Scholars School, Bhalla Farm, Kashipur, District Udham Singh Nagar till 21.09.2021. An FIR was lodged by the complainant, who is alleged to be the Assistant Manager of the school on 07.09.2023 i.e. almost after two years of his leaving the school. In the FIR, it is stated that applicant has stolen the stamp of the Managing Director and have issued forged and fabricated certificates to the teachers.

5. It has also been alleged that the applicant had given two commendable certificates to himself by fabricating the signature of the then Manager Pankaj Bhalla. Chargesheet has been filed in this matter. In the chargesheet, Investigating Officer has mentioned the fact that since original certificates are not available in the records, therefore, the same could not be sent to Forensic Science Laboratory for authentication of the signature. Applicant has denied the fact that he has neither stolen the stamp of the Principal of the College nor has he forged the signature of the then Manager Pankaj Bhalla.

6. Issue notice to respondent no. 2.

7. List after service report is received.

8. Meanwhile, counter-affidavit, if any, be filed by the respondent.

9. After perusing the records and having heard learned counsel for the parties, this Court, prima facie, is of the opinion and is satisfied that in the interest of justice, further proceedings of Criminal Case No. 2295 of 2024, State Vs. Subodh Kumar Singh, pending in the court of learned Additional Chief Judicial Magistrate, Kashipur, District Udham Singh Nagar shall remain stayed qua the applicant till the next date of listing.
