Ms. Sheetal Selwal, learned counsel for the petitioner.

2. Mr. Suyash Pant, learned Standing Counsel for the State/respondent nos.1 & 3.

3. Mr. V.S. Rawat, learned counsel for respondent no.2.

4. The petitioner has challenged the order dated 16.05.2023 issued by respondent no.2, whereby the petitioner has been debarred from participating in recruitment and competitive examinations for services under the State Government for a period of five years.

5. Learned counsel for the petitioner has placed reliance upon the order dated 19.07.2024 passed by the Coordinate Bench of this Court in WPSS No. 1281 of 2024 and has sought similar relief.

6. Be that as it may, this Court is of the opinion that, at this stage, it cannot be said that on the basis of the mere allegations contained in the debarment order dated 16.05.2023, the petitioner can be held guilty of the aforesaid misconduct. Consequently, the impugned order dated 16.05.2023, debarring the petitioner from appearing in examinations, appears to be harsh and unfair.

7. Let the counter affidavit be filed within four weeks.

8. List on 25.03.2026.

9. Having considered the submissions of learned counsel for the parties, the effect and operation of the impugned order dated 16.05.2023 shall remain in abeyance till the next date of listing.

10. The petitioner is directed not to claim the benefit of any advertisement issued by respondent no.2 during the period of debarment, subject to the final outcome of the writ petition.

11. The Registry is directed to indicate the name of Mr. V.S. Rawat, Advocate for respondent no.2.

12. The urgency application, exemption application as well as stay application stand disposed of.
