3. Present matter relates to FIR No.124 of 2025 under Sections 65(1) & 137 (2) of BNS and Section 5(1)/6 of POCSO Act under the jurisdiction of Police Station Sahaspur, District Dehradun in which appellant is in judicial custody in jail.

4. At the outset learned counsel for the appellant submits that firstly the present matter relates to two victims, who do not support the prosecution story and the victims are said to be 19 and 17 years old. The report of the first victim, who is said to be 19 years old, is lodged by brother of the victim,

Learned State counsel refutes to the submission, so advanced by learned counsel for the appellant, stating that the matter is otherwise and the victim have supported the prosecution's version; firstly both the victims are minor and secondly in the present incident relating to FIR there is another accused beside the present appellant, who has named as Bharat and one of the victim has specifically alleged that he committed sexual offence against her.

6. Learned State counsel seeks two weeks time to file objection in the matter.
