4. Mr. N.S. Pundir, learned D.A.G. with Mr. B.S. Koranga, learned Brief Holder for the State of Uttarakhand/respondent Nos.3 to 6.

5. Mr. Sagar Kothari, learned counsel for respondent No.7.

6. Short counter affidavit filed by respondent No.2 is taken on record. Misc. Application (IA/1/2025) made therefor, is allowed.

7. Delay in filing counter affidavits, is condoned. Delay Condonation Applications (IA Nos.2 & 3 of 2025) made therefor, are allowed. Counter affidavits filed by State, are taken on record.

8. Learned counsel for petitioner submits that he doesn't wish to file any rejoinder affidavit.

9. He further submits that in Para 6 of counter affidavit of respondent Nos.4 and 5/State, it has been stated that the amount, which is payable to petitioner, shall be paid to him from the money pending with respondent-department payable to the respondent No.7-Contractor and if the Contractor has any objection to it, he can raise his grievance before respondent No.1.

10. Having admitted the claim of petitioner and readiness to make the payment to petitioner, respondent Nos.4 and 5/State shall make payment of the amount of damages to the petitioner within six weeks' from today.
