2. Mr. K.P. Upadhyay, learned Senior Advocate assisted by Mr. Hemant Pant, Advocate for the respondent.

3. The case as unfolded from the pleadings of the petitioner is that the petitioner was working with the respondent as Junior Engineer (Civil). An F.I.R. was lodged against him on 09.03.2016 and therefore he was suspended on 14.03.2016. Subsequently the petitioner was convicted and he was terminated from service on 20.06.2017.

It is contended by learned counsel for the petitioner that on an appeal the conviction and sentence of the petitioner was set aside by judgment of this Court passed on 16.12.2025 in Criminal Appeal No.127 of 2017, Brijesh Kumar Singh Bhoj Vs. State of Uttarakhand. On his acquittal the petitioner has moved an application for his reinstatement which has not been decided as yet by the respondent-Institute.

5. Learned counsel for the respondent fairly submits that if a direction is issued by this Court to decide the application moved by the petitioner in a time bound manner, the same shall be considered.

6. In such view of the matter, the writ petition stands disposed of with a direction to the respondent to consider

the application moved by the petitioner dated 05.01.2026, annexure no.4 to the writ petition, within a period of six weeks, from the date of production of certified copy of this order, strictly, in accordance with law.
