Mr. Prince Chauhan, learned counsel for the petitioner.

2. Mr. N.S. Pundir, learned Deputy Advocate General for the State.

3. Petitioner has sought a writ of mandamus in the present writ petition, commanding respondent no. 3, the Regional Food Controller, Kumaun Region, Haldwani, to forthwith return the FDRs amounting to Rs. 15 lakhs to him.

4. It is contended by the learned counsel for the petitioner that the petitioner was awarded a contract for the procurement of paddy from farmers and for the custom hulling of the paddy so purchased, to be delivered to the respondents. Petitioner asserts that he has completed the work assigned to him under the contract; however, the security deposit of Rs. 15 lakhs, in the form of two FDRs, has not yet been returned.

5. Learned Deputy Advocate General prays for and is granted two days' time to seek instructions in the matter.
