Hon'ble Ashish Naithani, J., Mr. Ravindra S. Rawat, learned counsel for Appellant.

2. Mr. Devendra Singh, learned counsel holding brief of Mr. Narendra Bali, learned counsel for the Respondent.

3. Heard learned counsel for the parties.

4. The matter is pending for consideration of the Delay Condonation Application (IA No. 01 of 2025).

5. Learned counsel appearing for the Respondent objects to the said Delay Condonation Application on the ground that no sufficient grounds have been made out.

6. Learned counsel for the Appellant, however, explains the delay as stated in the application filed before this Court. The delay of 07 days is well explained; therefore, the same is hereby condoned. Accordingly, the Delay Condonation Application is allowed.

7. The present Application has been filed by the Complainant seeking Special Leave to Appeal against the judgment and order dated 28.02.2025, passed by the learned Additional Chief Judicial Magistrate/ IInd Additional Civil Judge (S.D), Haridwar, whereby the accused has been acquitted of the offence under Section 138 of the Negotiable Instruments Act, 1881.

8. After hearing learned counsel for the parties, this matter requires consideration.

9. Let the Trial Court's Record be summoned.

10. Upon receipt of the Trial Court's Record, the Registry is directed to prepare the paper book and furnish the same to the concerned parties, as per Rules.

11. Objections, if any, be filed by the Respondent.

12. List this case on 25.03.2026.
