Heard Mr. Siddhartha Singh, learned counsel for the appellants and Mr. Piyush Garg, learned counsel for the respondents.
2. A Withdrawal Application (IA No.2 of 2026) has been filed on behalf of the appellants seeking to withdraw the present appeal. In the said application, it has been stated that during the pendency of the present first appeal the parties have entered into an amicable settlement and have settled all their grievances. The appellant acknowledge and admit the right, title, interest and ownership of the respondents over the property in question and have handed over vacant and peaceful possession of the property in question to the respondents. All accounts have been settled and nothing is due as against each other. All grievances stand redressed. The parties have entered into the compromise without any pressure or duress. In view of the compromise between the parties, the appellants are not willing to prosecute the present first appeal further and are desirous of getting the present first appeal being dismissed as withdrawn.
3. In view of the averments made in the withdrawal application and there being no objection to it by the learned counsel for the respondents, the appellants are permitted to withdraw the present appeal.
4. Accordingly, the First Appeal is dismissed as withdrawn.
5. Let the file be consigned to records.
