1. Mr. Deepak Petshali, learned counsel for the revisionist.
2. Mr. Tumul Nainwal, learned A.G.A. with Mrs. Meenakshi Shama and Mrs. Sweta Badola Dobhal, learned Brief Holders for the State.
3. The instant criminal revision has been preferred by the revisionist-Pankaj S/o Jai Prakash against the judgment and order passed by the learned District and Session Judge, Champawat, in Criminal Appeal No. 07 of 2026 'State of Uttarakhand vs. Pankaj', whereby, the finding as recorded by the Trial Court has been reversed and the revisionist has been convicted with the sentence of one year simple imprisonment with a fine of Rs. 2,80,875/- under section 60(1)(b) of Excise Act and in default of payment of fine he has to further undergo one year simple imprisonment.
4. As per the office report, the revision is well within time.
5. Admit.
6. Summon the Trial Court record.
7. After hearing the arguments of learned counsel for the parties and taking into consideration that the Trial Court acquit the revisionist though the finding as recorded by the Trial Court has been reversed by the learned District and Session Judge by convicting the revisionist by granting interim bail.
8. Let the State may file their objection within ten days.
9. List this matter on 24.04.2026.
10. Interim bail granted by the learned District and Session Judge shall continue for the period of three weeks.
