Heard Mr. Tapan Singh, learned counsel for the appellants and Mr. Nikhil Singhal, learned counsel for the caveator.
2. The Amendment Application (IA No.02 of 2024) has been filed on behalf of the appellants on the premise that due to typographical mistake in the cause title, the respondent no.1 has been written as Hukum Chand, whereas he is already died. Therefore, the amendment application has been filed to permit the appellants to incorporate the amendment in the memo of parties/cause title and legal heirs of the respondent no.1 Hukum Chand be also incorporated in the memo of parties/cause title, which are as follows:-
1/1. Brijesh Chand S/o Hukum Chand 1/2. Vijendra Kumar S/o Hukum Chand 1/3. Shivkant S/o Hukum Chand All R/o Village Bahadrabad, Pargana Jwalapur, Tehsil and District Haridwar
3. There is no objection on the said amendment application by the learned counsel for the caveator.
4. The amendment is formal in nature. Accordingly, the Amendment Application (IA No.02 of 2024) is allowed.
5. The appellants are directed to carry out the requisite amendment and file amended memo of appeal within a period of one week.
6. List this matter on 04.06.2026.
