Mr. B.N. Molakhi, D.A.G. for the State. In this appeal against conviction, the appellant has filed IA No.05 of 2025 for Miscellaneous Application for taking on record certain Government Orders, etc. State was required to file objections to it. But today, learned State Counsel submits that no objection is required to be filed because whatever documents are proposed to be filed, they are Government records only.
Heard on the miscellaneous application.
Learned counsel for the appellant submits that, in fact, the date of incident, according to the prosecution in the instant case, is 24.07.2021, which was in the midst of COVID-19 pandemic, when curfew was clamped in most parts of the State of Uttarakhand. He submits that those documents are required to be perused so as to appreciate the evidence in the instant matter.
State has no objection in taking on record those documents. Therefore, the miscellaneous application is allowed.
In fact, the documents that are filed are not additional evidence. They are Government Orders. They may be referred to while hearing the appeal. List this matter on 28.04.2026, for final hearing.
