The present criminal revision under Section 438/442 of BNSS is moved on behalf of the Revisionist to acquit the Revisionist for the offence punishable under Section 7 of Essential Commodities Act, 1955, Police Station Tallital, District Nainital and in league to quash the judgment and order dated 15.10.2025 passed by learned 2nd Additional Sessions Judge, Nainital in Criminal Appeal No.8 of 2023, titled as "Bhawan Singh & Anr. Vs. State" as well as the judgment and order dated 31.03.2023 passed by learned Chief Judicial Magistrate, Nainital in Criminal Case No.1391 of 2017 (FIR No.07 of 2017) titled as "State vs. Bhawan Singh Bisht & Anr" for the offence punishable under Section 7 of Essential Commodities Act, 1955 and further to stay the realization of fine during pendency of criminal revision.
