There are three directions issued by this Court in the WPPIL No.116 of 2018, Kundan Singh Vs. State and Others ("the PIL"). The judgment has been affirmed by the Hon'ble Supreme Court. Now, it has been brought to the notice of the Court that the respondent/State has wilfully disobeyed the directions of this Court dated 12.11.2018.

During the course of hearing, learned Chief Sanding Counsel submits that he would get instructions on directions 'B' and 'C' as contained in Paragraph 34 of the judgment of which disobedience is reported.

He also submits that insofar as the directions in Paragraph 34-A is concerned, it is a policy matter.

This Court in clear terms has given directions in Para 34 of the judgment passed in the PIL.

Insofar as the directions contained in Para 34 'B' and 'C' are concerned, nothing is required to be done. It has to be acted upon. There is nothing with the State to sit over the directions issued by this Court.

Let learned Chief Standing Counsel get categorical instructions as to whether it has been implemented or not, and if it is not done, why it may not be considered wilful disobedience and the matter may further be not processed for framing charges on the person, who is responsible it.
