Mr. S.K. Chandel, learned counsel for the appellant.
2. The appellant proposes to challenge the judgment and order dated 22.01.2025 passed in Family Suit No.278 of 2023, Smt. Sunita Vs. Rajendra, by the court of Additional Principal Judge, Family Court, Kashipur, District Udham Singh Nagar. By the impugned judgment, a petition seeking divorce by the appellant under Section 13 of the Hindu Marriage Act, 1955 has been dismissed. There is a delay of 126 days.
3. Heard learned counsel for the appellant on the delay condonation application (IA No.1 of 2025).
4. Notices were issued to the respondent. According to the Registry report, notices are served but none appeared on behalf of respondent.
5. Having considered the grounds taken in the affidavit enclosed with the delay condonation application, this Court is of the view that there is a good ground to condone the delay, therefore, the delay in preferring the appeal is condoned and the delay condonation application stands allowed accordingly.
6. Issue fresh notices to the respondent, returnable within six weeks.
7. Steps to be taken within one week.
8. List this case on 08.12.2025.
