2. This criminal jail appeal filed by the appellant is received through Superintendent, District Jail Haridwar.
3. As per Office report, there is delay of 25 days' in filing the appeal. Since the appeal is filed through Jail by the appellant, therefore, the delay is not seriously opposed by learned State Counsel.
4. Accordingly, the delay in filing the criminal jail appeal is condoned.
5. This criminal jail appeal is directed against the judgment and order dated 18.07.2025 passed by Additional Sessions Judge/FTSC, District Haridwar in Special Sessions Trial No.160 of 2022, State vs. Jitendra @ Kaku, whereby the appellant was convicted under Sections 377 r/w Section 511 IPC and sentenced to undergo 05 years' R.I. with fine of Rs.20,000/- with default stipulation of 03 months' additional simple imprisonment under Section 377/511 IPC and under Section 10 of the POCSO Act, 2012, appellant was sentenced to undergo 05 years' R.I. with fine of Rs.20,000/- with default stipulation of three months' additional simple imprisonment. Both the sentences
were directed to run concurrently.
